Terms of Service

These Terms of Service ("Terms") govern your access to and use of danmu.io (the "Service"), operated by Zeptun Intelligence Limited ("we," "us," or "our"), a company incorporated in Hong Kong. By using the Service, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use the Service.

1. Description of Service

danmu.io is a cross-device transfer service that allows you to send text, files, links, and clipboard content between your registered devices. The Service consists of:

• A web application accessible at danmu.io
• Desktop applications for macOS and Windows (Tauri-based)
• Mobile applications for iOS and Android (React Native-based)

The Service offers a Free tier and a paid PRO subscription. Features and limitations vary by tier as described on our website and within the applications.

2. Account Registration

• Free Usage: You may use the Service without creating an account, subject to the limitations of the Free tier (currently 3 devices).
• PRO Subscription: To access PRO features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• Accuracy: You must provide accurate and complete information when creating your account and keep it up to date.
• Security: You must notify us immediately of any unauthorized access to or use of your account.

3. Acceptable Use

You agree not to use the Service to:

• Transfer illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable content.
• Transfer content that infringes upon the intellectual property rights of any third party.
• Distribute malware, viruses, or any code of a destructive nature.
• Attempt to gain unauthorized access to our systems, servers, or other users' accounts.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service for any purpose that is unlawful or prohibited by these Terms.
• Resell, sublicense, or redistribute the Service without our prior written consent.
• Abuse the Service through automated scripts, bots, or excessive usage that exceeds reasonable personal use.

We reserve the right to suspend or terminate your access if we reasonably believe you have violated these Acceptable Use provisions.

4. Subscription and Payments

• Pricing: PRO subscription pricing is displayed on our website and may be changed with 30 days' prior notice to existing subscribers.
• Billing: Payments are processed through Stripe. By subscribing, you authorize Stripe to charge your payment method on a recurring basis (monthly or yearly, depending on your plan).
• Free Trial: We may offer free trials for PRO features. Trial terms, including duration and eligibility, will be communicated at the time of offer.
• Refunds: Subscription fees are non-refundable except as required by applicable law or at our sole discretion.
• Cancellation: You may cancel your subscription at any time. Your PRO features will remain active until the end of your current billing period.
• Price Changes: We will notify you of any price changes at least 30 days before they take effect. Continued use after the change constitutes acceptance of the new pricing.

5. End-to-End Encryption

danmu.io uses AES-256-GCM end-to-end encryption for transfer content. This means your data is encrypted on your device before transmission and can only be decrypted by your other registered devices.

• What we can access: Metadata such as device names, transfer timestamps, and file sizes (without content) to provide the Service.
• What we cannot access: The actual content of your transfers — text, files, clipboard data, and URLs are encrypted with keys that exist only on your devices.
• Limitation: If you lose all your devices without recovery options, encrypted data cannot be recovered by us. PRO users may have cloud key backup options available.

While we employ strong encryption, no system is completely immune to security vulnerabilities. You acknowledge that you use the Service at your own risk and that we cannot guarantee absolute security.

6. Intellectual Property

• Our IP: The Service, including its design, code, graphics, logos, and documentation, is owned by Zeptun Intelligence Limited and protected by copyright and other intellectual property laws.
• Your Content: You retain all rights to the content you transfer through the Service. By using the Service, you grant us a limited, non-exclusive license to process and transmit your content solely for the purpose of providing the Service.
• Trademarks: "danmu.io" and the danmu.io logo are trademarks of Zeptun Intelligence Limited. You may not use these without our prior written permission.

7. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the Service will be uninterrupted, timely, secure, or error-free.
• Warranties that any data transferred through the Service will not be lost or corrupted.

You are solely responsible for maintaining backups of any important data you transfer through the Service.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Zeptun Intelligence Limited and its directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
• Any loss of data, loss of profits, or business interruption.
• Any unauthorized access to or alteration of your transmissions or data.
• Any actions or omissions of third parties, including other users of the Service.

In no event shall our total liability exceed the amount you have paid to us in the 12 months preceding the claim, or HKD 1,000, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Zeptun Intelligence Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising out of or related to:

• Your use of or inability to use the Service.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Content you transmit through the Service.

10. Termination

• By You: You may stop using the Service at any time. You may delete your account through the app settings or by contacting us.
• By Us: We may suspend or terminate your access to the Service at our sole discretion, with or without notice, if you violate these Terms or for any other reason.
• Effect of Termination: Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of law principles.

Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email (for registered users) or through a notice on our website at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms remain in full force and effect.
